使用條款及細則

用戶和CLICKnWASH 電腦洗車之間的協議

我們TL3 Limited在香港擁有並經營一項名為CLICKnWASH（“CLICKnWASH”）的電腦洗車服務。

A.    有關使用CLICKnWASH 流動應用程式的條款及細則 

我們為CLICKnWASH的用戶提供同名的流動應用程式（“程式”），以預約和支付我們的電腦洗車服務及/或其他產品、管理洗車預約，並在程式上管理帳戶相關的設置和偏好。通過下載並使用程式，您將被視為已經同意並接受這些條款及細則。如果您不接受這些條款和條件，請不要使用本程式。

程式的使用 

使用本程式時需要利用互聯網和適用於網絡供應商的正常收費。本程式僅供個人和非商業用途使用。您只能按照這些條款和條件使用本程式。您禁止使用本程式作為任何非法或欺詐的目的，或干擾本程式的操作或保安。

如果你使用本程式，即代表您已同意我們可以透過您的流動通信器材以電子方式與您溝通（例如透過推送通知）。

我們可能在沒有事先通知的情況下，終止、限制或暫停您進入或使用本程式，而不對您或任何其他人承擔任何責任。

如果您未滿18歲，除非獲得父母或成年監護人的許可，否則不得使用本程式。

進入程式

您可於無需創建會員帳戶或登入本程式的情況下，到訪或瀏覽本程式的某些部分。例如，您可以瀏覽我們洗車服務的預約狀態、洗車程序定價及詳細資料、店舖位置或閱讀我們的最新消息和促銷。但是，如果您想預訂洗車時段並進行付款程序，則需要通過創建新帳戶註冊或使用現有帳戶登入。

在程式上創建帳戶

您可以在第一次到訪本程式時創建一個新帳戶。我們尊重您的隱私，僅在“必要知道”的基礎上收集您的個人資料。要創建一個新帳戶，我們唯一需要的個人資料就是您的手機號碼。您需要通過驗證碼驗證您的手機號碼，並創建一個密碼，其中必須包含大小寫字母（a-z和A-Z）和數字（0-9）的組合。請勿與其他人分享您的密碼。

透過本程式預訂洗車 

首先在本程式的「現在預訂」部分選擇店舖位置、日期、時間和洗車程式，您便可以開始預約洗車。

然後您需要輸入車牌號碼。由於我們只根據車牌號碼 (而不是您的姓名、手機號碼或任何其他方式) 來確認每個預約，所以準確地輸入車牌號碼至為重要。預約只對預訂過程中輸入的車牌號碼有效，並且預約不可轉換給其他車輛。您須對輸入的車牌號碼的準確性負全責。如在預約時段到達要求服務的車輛與預訂過程中輸入的車牌號碼不符，我們保留不提供服務的權利。

僅通過車牌號碼識別預約，意味著作為程式用戶，您可以靈活地為屬於您或任何其他人的車輛（例如您的配偶，您的朋友或您的合作夥伴）預並支付CLICKnWASH洗車費用。

預訂過程中可選擇提供的其他資料 

我們尊重您的隱私，所以您可以選擇自行決定在本程式中提供更多資料。如果您提供此類資料，則可以增強程式的用戶體驗。跳略過這些資料並不會影響你的預約的合格性，但本程式的某些功能或優惠將不適用。

以下都是可選性資料：

Shell Bonus Card號碼 – 由於香港蜆殼有限公司已取消Shell Bonus Card有關之會員計劃並且已由Shell GO+計劃代替，本手機程式內與Shell Bonus Card有關之資料收集及優惠亦不再適用。

優惠碼 – 如果您擁有有效的CLICKnWASH優惠碼，您可以在預訂過程中選擇使用該優惠碼以享受洗車折扣優惠。

顧客留言 – 您可以在這裏提出對我們服務或產品的意見、問題或反饋。

電子郵件地址 – 如果您希望透過電子郵件收到正式的預約收據，您可以選擇提供一個電郵地址。如果您不提供此資料，您則不會透過電郵收到收據。不過，您仍然可以在本程式的「我的預約」部分查看您的預約詳情。您只需輸入這資料一次，本程式便可儲存為未來的預約之用。您也可以隨時在本程式的「設定」部分更改或刪除此資料。

捐款收據上的姓名和郵寄地址 – 如果預約服務的車輛遲到超過10分鐘或者錯過了預約時段，該預約將會被取消，已繳付的金額將不獲退還，但會以您的名義捐贈給我們的慈善合作夥伴（“捐贈程序”）。一旦啟動了捐贈程序，而如果您在預訂過程中提供了姓名和郵寄地址，我們的慈善合作夥伴將向該人發出官方捐款收據。您提供的名字不一定是您的名字，您可以選擇輸入其他人的姓名。如該資料是空白或不完整，您取消預約的金額仍會被捐贈給我們的慈善合作夥伴，但會以CLICKnWASH的名義捐贈。請閱覽我們的「退款政策」以了解更多詳情。

透過本程式付款 

如果您使用了有效的優惠碼，此等折扣將從您選擇的洗車程式價格中被扣除。在確認預約前，請確保所有細節都是正確。於店舖內，我們不接受現金方式付款。所有於本程式內進行之CLICKnWASH洗車服務及/或產品的付款必須利用Visa、Mastercard、Apple Pay、Android Pay或PayPal進行。您的付款請求將被安全地傳輸給我們的第三方付款關口服務供應商，並由其獨立處理。一旦付款成功處理，您的CLICKnWASH預約即被確認。

預約提示 

如果您於 1天前或以上預訂CLICKnWASH洗車服務，本程式的訊息或訊息推送會自動在您預約日期前1天及預約前約60分鐘發出提示。如果您於不超1天前預訂CLICKnWASH洗車服務，您將只會在預約前60分鐘透過本程式收到訊息或訊息推送提示。

在預約時間過後，本程式將根據洗車程序是否完成、失約或被取消，或需要退款，向您的電子通訊設備發送各種訊息。

如您不希望收到此等提示訊息，請關閉你的流動通訊器材在程式中接收提示信息的設定。

取消預約 

您須了解並同意，一旦付款成功，您的預約便不能被取消。您也須清楚並同意，已支付的預約時段，不能由已經預約的車牌號碼轉移到另外的車牌號碼的車輛，即使您是該車輛的擁有者。但是在某些情況下，退款是可以安排。請閱讀我們的「退款政策」以了解詳情。

知識產權 

我們是程式所有內容和材料的知識產權擁有者，包括但不限於我們的公司名稱、公司標誌、設計、圖形、圖標、文本、代碼、軟件、界面、圖像和視頻（“材料“）。未經我們許可或授權，您或代表您的任何人嚴禁以任何形式或媒體，公開或私下複制、修改、分發、傳輸或存儲此等材料。

隱私政策

您透過本程式提供的個人資料，只會根據我們的隱私政策使用。請閱讀我們的「隱私政策」以了解詳情。

免責聲明和責任

您需要對您在本程式中提供的資料的準確性負責。我們會盡最大努力確保本程式中所包含的或透過本程式提供的資料、產品、服務或其他內容和材料在發佈時是準確的。我們不保證本程式不包含不準確的地方或印刷錯誤。

您理解並同意，使用本程式時須自擔風險，並承擔您到訪和使用本程式的所有風險和責任，包括提交您的個人資料的風險。

修訂

我們保留隨時修改、更改或更新本條款及細則的權利，而恕不作另行通知。透過繼續使用本程式，將代表您承認和接受本條款及細則及其修訂。如果您不同意這些條款和條件，您唯一的補救措施就是停止使用本程式。

條款分離

每個條款和條件屬單獨運作。如果任何法院或有關當局發現某些條款和條件的任何條款無效或不可執行，其餘條款和條件仍然完全有效。

終止

如果您未能遵守這些條款和條件的任何規定或違反了本協議的條款或精神，我們將保留在任何時候及沒有任何理由的情況下終止您的會員賬戶或您到訪本程式及其服務的權利，而不作另行通知，也不承擔任何責任。

B.  有關 CLICKnWASH洗車及其相關服務的使用條款

在使用CLICKnWASH洗車及相關服務之前，請仔細閱讀這些使用條款。透過在我們店舖使用我們的洗車及相關服務，即表示你已閱讀、確認、理解並同意受這些使用條款約束。如果您不同意這些使用條款，請不要使用我們的洗車或其相關服務。

定義和解釋

“預約時間”是指CLICKnWASH 程式的用戶可以透過付款以預訂保留的20分鐘洗車服務時段。在每個店舖的每個服務小時內，有3節預訂時段，分別是：00、：20和：40。

“進入車輛”是指無論在預約時段或其他時段內進入CLICKnWASH店舖範圍的車輛。

“司機” 是指駕駛及控制車輛進入CLICKnWASH店舖範圍的人士。

“乘客”是指“進入車輛”之內的任何其他人（司機除外）。

“準時”是指預約洗車服務的車輛在預約時段開始計起的10分鐘之內抵達洗車店舖。

“洗車操作員”是指操作洗車程序的負責人。

“洗車間區域”是指CLICKnWASH店舖的透明捲閘之內的任何地方空間。

在預約時段抵達

為了不影響隨後的洗車預約，司機須負責確保已預約洗車服務的車輛於預約時段準時到達。所有預約了服務的車輛應在預約時間的10分鐘之內到達。例如，預約時間為11:00，車輛應在11:00至11:10之間抵達。

如預約了洗車服務的車輛遲到10分鐘以​​上，或者根本沒有出現，該次預約將會被自動取消。程式用戶已支付的金額將不獲退還，而會以程式用戶在預訂期間的指定人士的名義捐贈給我們的慈善合作夥伴。

如預約了洗車服務的車輛在預約時段之前到達，我們有機會可以提早提供服務。我們不保證預約時段前必定可以提早提供洗車服務，洗車操作員將有是否能夠提早提供服務的決定權。

不適合使用CLICKnWASH電腦洗車服務的車輛 

在進入CLICKnWASH店舖範圍之前，司機有全部責任確保”進入車輛”的尺寸適合我們的洗車間，並且”進入車輛”適用於CLICKnWASH店舖的電腦洗車服務。

我們的洗車機只能為以下尺寸的車輛服務：

  1. 車底的距離不小於15厘米
  2. 高度不超過2.1米
  3. 寬度不超過1.9米
  4. 長度不超過4.9米

CLICKnWASH店舖的電腦洗車服務不適合有以下情況或裝置的車輛：

  1. 擋風玻璃有裂縫、碎片或花痕
  2. 經過改動
  3. 後加零件
  4. 擾流板、尾門、前後泵把、天線、車頂架或外部備用車輪
  5. 外部零件鬆動或損壞，包括但不限於車牌、徽章、導向板、側後視鏡、保險槓、擾流板、鍍鉻物、裝飾或其他外部附加裝置

司機及/或乘客的責任 

在使用我們的洗車及相關服務之前，司機及/或乘客有責任：

  1. 收回電源天線或移除可拆卸的天線
  2. 確保所有窗戶和天窗完全關閉
  3. 確保所有側鏡完全收回
  4. 確保所有車牌、導流板、後視鏡、保險槓、擾流板、鉻合金、裝飾件或任何其他外部零件在進入洗車間之前是沒有鬆動或損壞
  5. 確保”進入車輛”是停泊於導軌之間，並遵照洗車操作員的指示和洗車機的訊號燈正確對準洗車間
  6. 遵守店舖內的其他安全指引或洗車操作員的指示

如果司機及/或乘客未能遵守上述要求，我們保留不對”進入車輛”提供服務的權利，並且沒有任何退款。請參閱我們的「退款政策」以了解詳情。

車輛進入或退出洗車間的注意事項 

安全是我們的首要任務。在駕駛車輛進入或退出我們的店鋪之前，司機應該極其小心，並提防：

  1. 街上任何可能阻礙進出我們店舖的障礙物
  2. 在街上或行人道上的行人 司機應遵循洗車操作員的指引和指示。

當”進入車輛”被引導到所需的位置並且已經完全停下時，司機及/或乘客可以小心地走出”進入車輛”。完成洗車服務後，司機及/或乘客可以小心返回”進入車輛”。司機及/或乘客應該提防：

  1. 濕滑地面
  2. 不平坦的地面
  3. 導軌
  4. 地面上任何可能會引致摔倒的其他障礙物

洗車服務進行期間 

基於安全理由，在洗車程序及/或洗車機運行期間，司機及/或乘客嚴禁：

  1. 逗留在”進入車輛”
  2. 停留留在或進入洗車間區域

如果司機及/或乘客未能遵守這些安全要求，我們將終止洗車程序，且不予退款。

盡量服務的基礎 

我們將盡最大努力提供服務，但是如未能對”進入車輛”清除污漬或回復任何表面或狀況，我們將不承擔任何責任。

免責聲明和責任 

您及/或司機須明確同意使用我們的任何服務是要自擔風險。在適用法律允許的最大範圍內，我們以“現狀”和“現有”的基礎提供洗車及相關服務。

無論是CLICKnWASH或是其員工均未能評估”進入車輛”是否適合使用本洗車服務。您及/或司機有責任根據上述警告確定”進入車輛”是否適合使用本洗車服務。

對於因洗車而導致的任何損壞或傷害，包括但不限於對您、司機、乘客、”進入車輛”或”進入車輛”內部的財產造成的損害，我們概不負責。

在任何情況下，即使我們及/或我們的員工、任何有關連人士或代理人已被告知可能會受到損害，我們和/或我們的員工、 任何有關連人士或代理人對您或任何人不承擔任何因使用本洗車服務而導致的直接性、間接性、懲罰性、偶然性、特殊性、後果性或任何損害賠償責任，包括但不限於利潤損失、收入損失、業務損失、使用損失或數據損失；或因延遲或無法使用本洗車服務、本洗車服務未能提供服務、無論是基於合同、侵權、疏忽、嚴格責任還是其他方式。

修訂

我們保留隨時修改、更改或更新本使用條款的權利，而恕不另行通知。最新版本的使用條款將取代所有以前的版本。使用條款更新之後繼續使用我們的CLICKnWASH洗車及其相關服務，即構成您接受當時有效的更新使用條款。

條款分離

每個使用條款及細則屬單獨運作。如果任何法院或有關當局發現某些使用條款及細則無效或不可執行，其餘條款及細則仍然完全有效。

TERMS AND CONDITIONS OF USE

AGREEMENT BETWEEN USER AND CLICKnWASH CAR WASH

We, TL3 Limited, own and operate an automated car wash service called CLICKnWASH (“CLICKnWASH”) in Hong Kong.

A.  TERMS AND CONDITIONS RELATED TO USING THE CLICKnWASH MOBILE APPLICATION

We provide users of CLICKnWASH a mobile application of the same name (“the App”) to reserve and pay for our automated car wash services and/or other products, manage car wash bookings, and manage account-related settings and preferences on the App. By downloading and using the App, you will be deemed to have agreed and accepted these terms and conditions. If you do not accept these terms and conditions, please do not use the App.

USE OF THE APP

Use of the App requires access to the internet and your carrier’s normal rates apply. The App is made available for your personal and non-commercial use only. You may only use the App in accordance with these terms and conditions. You are prohibited form using the App for any purpose that is unlawful or fraudulent, or interferes with the operation or security of the App.

By using the App, you agree that we may communicate with you by electronic means to your mobile devices (for example, by push notifications).

We may at any time, without assigning any reasons therefore and without prior notice, terminate, restrict or suspend your access or use of the App, without any liability to you or any other person.

If you are under the age of 18, you may not use the App unless you have the permission from your parent or an adult guardian.

ACCESSING THE APP

You may access or browse some parts of the App without creating a member’s account or otherwise without signing in. For example, you may browse booking availability status of our car wash service, pricing and details of car wash programs, shop location information, or read our news, promotions or announcements. However, if you want to reserve a car wash time slot and secure it by a payment, you would need to sign up by creating a new account or log in with your existing account.

CREATING AN ACCOUNT ON THE APP

You can create a new account on the App when you first access the App. We respect your privacy and collect your personal information only on a “need to know” basis. To create a new account, the only personal information that we require from you is your mobile phone number. You verify your mobile phone number by generating a verification code, and create a password which must consist of a mix of upper and lower case letters (a-z and A-Z) and numbers (0-9). Do not share your password with anyone else.

BOOKING A CAR WASH ON THE APP

You can begin to book for a car wash by first selecting a Shop Location, Date, Time Slot, and a Car Wash Program under the Book Now section of the App.

Then you input a Vehicle License Plate Number (“VLPN”). Since we identify each booking solely by the VLPN and not by your name, mobile phone number or any other means, inputting the VLPN accurately and correctly is critically important. The booking being created is valid only for the vehicle with the VLPN inputted and is non-transferrable to another vehicle. You are solely responsible for the accuracy of the VLPN. We reserve the right of not offering services in case the vehicle arriving for service does not match the VLPN specified in the booking.

Identifying a booking solely by the VLPN means that you, as the App user, have the flexibility to book and pay for a CLICKnWASH car wash for a vehicle belonging to you or anyone else (for example, your spouse, your friend or your co-worker).

OPTIONAL INFORMATION THAT YOU MAY CHOOSE TO PROVIDE DURING BOOKING

We respect your privacy. You can choose to provide additional information in the App at your own discretion. If you provide such information, your user experience of the App can be enhanced. Skipping such information will not affect the validity of the booking; however, some features or benefits of the App will not be available to you.

The following is all optional information:

Shell Bonus Card Number – Since Shell Hong Kong Limited has discontinued Shell Bonus Card loyalty program and has replaced it with Shell GO+ loyalty program, all data collection and promotion related to Shell Bonus Card in the App is no longer applicable.

Promotional Code – If you possess a valid CLICKnWASH Promotional Code, you may choose to use the code during booking to apply a discount to the Car Wash Program price.

Customer Comments – You can leave us comments, questions or feedback about our services or products.

Email Address – You can choose to provide an email address if you wish to receive an official booking receipt by email. If you do not provide such information, you will not receive a receipt by email. However, you can still review your booking details in the My Bookings section of the App. You only need to input this information once as the App can save the information for your future bookings. You can also change or delete this information in the Settings section of the App at any time.

Name and Mailing Address on Donation Receipt – If the vehicle that booked for service is more than 10 minutes late for the booked time slot or completely misses the booking, the booking will be automatically cancelled; the amount you paid will not be refunded but instead will be donated to our charitable partner in your name (“the Donation Sequence”). If under such circumstances that the Donation Sequence is triggered and if you have provided a name and a mailing address during booking, an official donation receipt will be made from our charitable partner to that person. The name you provide, however, does not necessarily have to be your name. You may enter another person’s name. If the information is blank or incomplete, your paid amount of the cancelled booking will be donated to our charitable partner as a donation by CLICKnWASH. Please also read our Refund Policy for further details.

PAYMENT VIA THE APP

If you have used a valid Promotional Code, the applicable discount will be deducted from the price of the Car Wash Program that you have selected. Prior to confirming the booking order, please ensure all details are correct. We do not accept cash or other means of payment at the shop locations. All payments for CLICKnWASH car wash services and/or products must be made through the App, by Visa, Mastercard, Apple Pay, Android Pay or PayPal. Your payment request will be securely transmitted to and independently processed by our third party payment gateway service provider. Once payment is successfully processed, your CLICKnWASH booking is confirmed.

BOOKING REMINDERS 

If you have booked for CLICKnWASH car wash services more than 1 day in advance, you will receive a 1-Day Reminder approximately 1 day before your booking date, and a 60-Minute Reminder approximately 60 minutes before your booking time, by means of push messages and notification messages automatically generated by the App. If you have booked for CLICKnWASH car wash services less than 1 day in advance, you will only receive a 60-Minute Reminder approximately 60 minutes before your booking time, by means of push message and notification message automatically generated by the App.

After the booking time slot has passed, the App will send various messages to your mobile device, depending on whether the car wash was completed, missed or cancelled, or whether refund of payment is required.

If you do not wish to receive reminder messages by the App, please turn off the app-specific notifications on the settings of your mobile device.

CANCELLATION OF BOOKING

You understand and agree that, once payment has been made, booking orders cannot be cancelled. You also acknowledge and agree that, the booking made under one VLPN cannot be transferred to another vehicle with a different VLPN for the purpose of taking up the booked and paid time slot, even if you are the owner of the other vehicle. There are, however, some situations where refunds can be made. Please read our Refund Policy for further details.

INTELLECTUAL PROPERTY RIGHTS

We are the owner of all intellectual property rights to the content and materials on the App, including but not limited to, our trading name, logos, designs, graphics, icons, text, codes, software, interface, images and videos (“Materials”). No permission or authorization is granted to you, or anyone acting on behalf of you, to reproduce, modify, distribute, transmit or store the Materials in any forms or media, in public or in private. Any unauthorized use of the Materials is strictly prohibited.

PRIVACY POLICY

Personal information that you provided through the App will only be used in accordance with our Privacy Policy. Please read our Privacy Policy in full for details.

DISCLAIMERS AND LIABILITY

You are responsible for the accuracy of the information that you provide in the App. We have tried to the best of our efforts to ensure that the information, products, services, or other content and materials included in or available through the App are accurate at the time of publishing. We make no warranty that the App may not contain inaccuracies or typographical errors.

Notwithstanding the above, under no circumstances shall we and/or our associates be liable to you or to anyone for any direct, indirect, punitive, incidental, special, consequential or any damages whatsoever, including but not limited to, damages for lost profits, loss of revenue, loss of business, loss of use, or loss of data, that result from the use of the App, the delay or inability to use the App, the provision of or failure to provide services by the App, or for any information, products, services included in or available through the App, whether based on contract, tort, negligence, strict liability or otherwise, even if we or any of our associates have been advised of the possibility of damages.

To the maximum extent permitted by applicable law, we provide the App and its related services on an “as is” and “as available” basis. We disclaim all warranties of any kind, whether express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular use or purpose, title, and non-infringement. We make no warranty that the App and its services will meet your requirements, or that the services will be timely, uninterrupted, secure or error free, or that any information, products, services, or other content and materials included in or available through the App will be free of viruses, bugs or other harmful components that may interfere with or damage the operation of your devices.

You understand and agree that you use the App entirely at your own risk and accept all risk and responsibility for your access to and use of the App, including the submission of your personal information.

AMENDMENT

We reserve the right to modify, alter, or update the terms and conditions at any time without prior notice. By continuing to use the App following such amendments constitutes your acknowledgement and acceptance of the terms and conditions and its modifications. If you do not agree with the terms and conditions, your sole and exclusive remedy is to discontinue the use of the App.

SEVERANCE

Each of the terms and conditions operates separately. In the event of any provision of these terms and conditions being found by any court or relevant authority to be invalid or unenforceable, the remaining terms and conditions shall remain in full force and effect.

TERMINATION

We reserve the right to terminate your member’s account or your access to the App and its services at any time, for any or no reason, without notice and without liability to you or anyone else if you violated the letter or the spirit of this agreement or fail to comply with any provision of these terms and conditions.

LANGUAGES

Should there be any differences or inconsistencies between the Chinese and English versions of these terms and conditions, the English version shall prevail.

B.  TERMS OF USE OF THE CLICKnWASH CAR WASH AND ITS RELATED SERVICES

Please read these Terms of Use carefully before using our car wash and its related services at the CLICKnWASH shop locations. By using our car wash and its related services at our shop locations, you confirm that you have read, understood and agreed to be bound by these Terms of Use. If you do not agree to these Terms of Use, please do not use our car wash or its related services.

DEFINITIONS AND INTERPRETATION

“Booking Time Slot” means the 20-minute duration that a user of the CLICKnWASH mobile app can reserve and pay to secure car wash services. Within each service hour at each shop location, there are 3 Booking Time Slots, at :00, :20, and :40. 

“Entering Vehicle” means any vehicle which enters the CLICKnWASH shop area boundary, no matter whether the vehicle has entered during a reserved Booking Time Slot or at other time periods.

“Driver” means the person controlling the Entering Vehicle which enters the CLICKnWASH shop area.

“Passengers” means any other persons (other than the Driver) inside the Entering Vehicle.

“On Time” means the vehicle which has booked for car wash services arriving at the car wash shop location within 10 minutes counting from the beginning of the Booking Time Slot.

“Car Wash Operator” means the person in charge of the operation of the car wash procedures.

“Car Wash Bay Area” means any floor space inside and within the clear roller gate at the CLICKnWASH shop location.

ARRIVING ON TIME AT THE BOOKING TIME SLOT

The Driver is responsible for ensuring the vehicle that has booked for car wash service arrives On Time at the Booking Time Slot. In order not to affect subsequent bookings, all vehicles that have booked for service should arrive within 10 minutes of the Booking Time Slot. For example, if the Booking Time Slot is 11:00, the vehicle should arrive between 11:00 and 11:10.

If the vehicle that has booked for car wash service is more than 10 minutes late or does not show up for the booking at all, the booking will be cancelled automatically. The paid amount by the App user will not be refunded but instead will be donated to our charitable partner in a name designated by the App user during the booking on the App.

If the vehicle that has booked for car wash service arrives earlier that the Booking Time Slot, we may be able to offer car wash service earlier than the Booking Time Slot. The offer of car wash service earlier than the Booking Time Slot is not guaranteed and is solely on the discretion of the Car Wash Operator.

VEHICLES NOT SUITABLE FOR AUTOMATED CAR WASH SERVICE AT CLICKnWASH

Before entering the CLICKnWASH shop area, it is the sole responsibility of the Driver to ensure that the size of the Entering Vehicle can fit into our car wash bay and the Entering Vehicle is suitable for automated car wash service at our CLICKnWASH shop locations.

Our car wash machine can only service vehicles within the following dimensions:

  1. no less than 15cm clearance underneath
  2. height within 2.1m
  3. width within 1.9m
  4. length within 4.9m

Automated car wash service at our CLICKnWASH shop locations are not suitable for vehicles with:

  1. windshields with existing cracks, chips, or nicks
  2. alternations from factory construction
  3. aftermarket parts
  4. spoilers, upper tailgates, lips, antennas, roof racks, or exterior spare wheel
  5. loose or damaged exterior parts, including but not limited to, license plates, badges, deflectors, side mirrors, bumpers, spoilers, chrome, trims, or other exterior attachments

RESPONSIBILITIES OF THE DRIVER AND/OR PASSENGERS

Before using our car wash and its related services, the Driver and/or Passengers are responsible for:

  1. retracting power antennas or removing removable antennas
  2. ensuring all windows and sun roofs are completely closed
  3. ensuring all side mirrors are fully retracted
  4. ensuring all license plates, deflectors, side mirrors, bumpers, spoilers, chrome, trims, or any other exterior parts are not loose or damaged prior to entering the car wash
  5. ensuring that the Entering Vehicle is positioned between the guide rails and is correctly aligned in the car wash bay in accordance with the instructions of the Car Wash Operator and the signal lights of the car wash machine
  6. following other safety guidelines at the shop locations or instructions by the Car Wash Operator

If the Driver and/or Passengers failed to comply with the above requests, we reserve the rights of not servicing the Entering Vehicle and without any refund. Please see our Refund Policy for further details.

PRECAUTIONS WHEN VEHICLE ENTERING OR EXITING THE CAR WASH

Safety is our top priority. Before driving the Entering Vehicle into and out of our shop location, the Driver should exercise extreme cautions and be beware of:

  1. any obstacles on the street that may obstruct turning into or out of our shop
  2. pedestrians walking on the street or sidewalk

The Driver should follow the instructions and directions of the Car Wash Operator.

When the Entering Vehicle has been steered to a desired position and has come to a full stop, the Driver and/or Passengers may step out of the Entering Vehicle carefully. When a car wash has completed, the Driver and/or Passengers may step into the Entering Vehicle carefully. In particular, the Driver and/or Passengers should be beware of:

  1. wet or slippery floors
  2. uneven grounds
  3. guide rails
  4. other obstacles on the ground which may trigger any trip or fall

DURING THE CAR WASH

For safety reasons, during a car wash and/or the car wash machine is in operation, the Driver and/or Passengers are strictly prohibited from:

  1. remaining inside the Entering Vehicle
  2. remaining inside or entering the Car Wash Bay Area

If the Driver and/or Passengers failed to comply with these safety requirements, we will terminate the car wash procedure and without any refund. 

BEST EFFORTS BASIS 

You agree that our services are provided on a best efforts basis. We will not be held responsible in the event that the car wash is unable to clean, remove stains, or otherwise restore any surface or condition on the Entering Vehicle.

DISCLAIMERS AND LIABILITY

You and/or the Driver expressly agree that use of any of our services is at your own risk. To the maximum extent permitted by applicable law, we provide the car wash and its related services on an “as is” and “as available” basis.

Neither CLICKnWASH nor its employees have assessed the Entering Vehicle for suitability for use of the car wash services. You and/or the Driver are responsible for determining on the basis of the warnings set out above whether or not the Entering Vehicle is suitable for use of the car wash services.

We shall not be liable for any damage or injury whatsoever caused by the car wash, including but not limited to, damage caused to you, the Driver, Passengers, the Entering Vehicle, or properties inside the Entering Vehicle.

Under no circumstances shall we and/or our employees, associates, or agents be liable to you or to anyone for any direct, indirect, punitive, incidental, special, consequential or any damages whatsoever, including but not limited to, injuries, damages for lost profits, loss of revenue, loss of business, loss of use, or loss of data, that result from the use of the car wash services, the delay or inability to use the car wash services, or the provision of or failure to provide services by the car wash services, whether based on contract, tort, negligence, strict liability or otherwise, even if we or any of our employees, associates, or agents have been advised of the possibility of damages.

AMENDMENT

We reserve the right to modify, alter, or update the Terms of Use at any time without prior notice. The most current version of the Terms of Use will supersede all previous versions. Use of our CLICKnWASH car wash and its related services following any updates constitutes your acceptance of the updated Terms of Use then in effect.

SEVERANCE

Each of the terms and conditions operates separately. In the event of any provision of these terms and conditions being found by any court or relevant authority to be invalid or unenforceable, the remaining terms and conditions shall remain in full force and effect.
